DMCA Policy and Canadian Notice-and-Notice

We respect intellectual property rights and expect users to do the same. Although our Site hosts limited user-generated content, we maintain the following process to address copyright concerns.

A. U.S. Digital Millennium Copyright Act notice

If you believe material on our Site infringes your copyright, send a written notice that includes all elements required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or authorized agent.

  2. Identification of the copyrighted work claimed to be infringed.

  3. Identification of the material claimed to be infringing and information reasonably sufficient to locate it, such as a URL.

  4. Your contact information – name, mailing address, phone number, and email.

  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.

  6. A statement that the information in the notice is accurate and, under penalty of perjury, you are the copyright owner or authorized to act on the owner’s behalf.

Upon receiving a compliant notice, we will remove or disable access to the material and notify the affected user, if applicable.

Counter-notice

If your material was removed in error, you may send a counter-notice under 17 U.S.C. § 512(g)(3) including:

  • Your physical or electronic signature.

  • Identification of the material removed and where it appeared before removal.

  • A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification.

  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your address, or if outside the U.S., to jurisdiction in any district where we may be found, and that you will accept service of process from the original complainant.

Note: To benefit from DMCA safe harbors, service providers generally register a designated agent with the U.S. Copyright Office. Our public agent contact is provided above.

B. Canadian Notice-and-Notice regime

For matters under Canada’s Copyright Act, rights holders may send a notice of claimed infringement that meets section 41.25 content requirements to general@footcareonbay.com. We will forward compliant notices to subscribers or account holders, if applicable, and retain related records as required. We do not disclose subscriber identity without a valid court order.

C. Repeat infringement and policy misuse

We may restrict access or terminate accounts of users who repeatedly infringe intellectual property rights. We may reject abusive, incomplete, or knowingly false notices.
